Industrial Matters in Acadiana
South Louisiana is home to fabrication yards, petrochemical and LNG facilities, ports, and heavy manufacturing. When an out-of-state firm's client is involved in a dispute or project at an industrial facility here, we provide Louisiana-licensed local counsel and on-the-ground support.
Issues We Help Out-of-State Counsel Navigate
- Facility construction and turnaround work. Private Works Act privileges (La. R.S. 9:4801 et seq.) on plant and facility projects, and payment disputes up and down the contract chain.
- Construction-contract limits. La. R.S. 9:2780.1 voids certain indemnity and additional-insured provisions in construction contracts that cover the indemnitee's own negligence. La. R.S. 9:2779 limits out-of-state forum and choice-of-law clauses in certain construction contracts, but a 2026 amendment (Acts 2026, No. 132) excludes upstream, midstream, and downstream oil, gas, chemical, petrochemical, and fuel manufacturing facilities and infrastructure, so many plant projects may fall outside it. Federal courts have also held that the Federal Arbitration Act can override its out-of-state arbitration restriction.
- Equipment and supply disputes, including Civil Code warranty and redhibition concepts for defective goods.
- Prescription. Many delictual (tort) claims arising after July 1, 2024 are subject to a two-year period (La. C.C. art. 3493.1); older claims were generally subject to one year.
- Federal court practice in the Western District of Louisiana, including diversity matters.
